General Terms and Conditions (GTC) – Kayu Ceramics

1. Scope of Application

These Terms and Conditions apply to all contracts for participation in pottery courses concluded between Kayu Ceramics and customers via the website.

2. Subject Matter of the Contract

The subject of the contract is participation in fixed-date pottery courses offered by Kayu Ceramics. The type, content, duration, location, and price of each course are specified in the respective course description on the website.

3. Conclusion of Contract

The presentation of courses on the website does not constitute a legally binding offer, but rather an invitation to book.

By completing the booking via the online booking system, the customer submits a binding offer to conclude a contract. The contract is concluded upon completion of the booking.

4. Prices and Payment

The prices stated at the time of booking apply.

Payment is made using the payment methods offered during the booking process (e.g. bank transfer or other available payment methods).

The course place is only reserved once the booking has been successfully completed.

5. Participation in Courses

The courses take place on the specified fixed dates. The customer is responsible for arriving on time for the course.

6. Cancellation by the Customer

The customer may cancel their booking under the following conditions:

  • up to 14 days before the course starts: free cancellation
  • 13 to 7 days before the course starts: 50% of the course fee
  • 6 days or less before the course starts or in case of no-show: 100% of the course fee

The date of receipt of the cancellation by Kayu Ceramics is decisive.

7. No Statutory Right of Withdrawal

For bookings of fixed-date pottery courses, there is no statutory right of withdrawal pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), as these are leisure services provided on a specific date.

8. Cancellation or Changes by the Provider

Kayu Ceramics reserves the right to cancel or reschedule courses for important reasons. Important reasons include in particular:

  • failure to reach the minimum number of participants
  • illness of the instructor
  • force majeure or other unforeseen events

In the event of cancellation, the customer will either be offered an alternative date or receive a full refund of any course fees already paid.

Further claims, in particular claims for damages (e.g., travel or transportation costs), do not exist.

9. Copyright

The content published on this website, in particular texts, photos, and other works, is subject to copyright held by Kayu Ceramics unless otherwise stated.

Any reproduction, editing, distribution, or other use beyond the limits of copyright law requires the prior written consent of Kayu Ceramics.

Downloads and copies of these contents are permitted only for private, non-commercial use.

Where content on this website was not created by Kayu Ceramics, the copyrights of third parties are respected, and such content is identified accordingly.

Some of the photographs used on this website are taken by an external photographer and are subject to her copyright. The corresponding rights are indicated in the legal notice (Impressum).

If you nevertheless become aware of a copyright infringement, please notify us. Upon becoming aware of such violations, we will remove the content immediately.

10. Liability

Kayu Ceramics is only liable for damages caused intentionally or by gross negligence. In cases of slight negligence, Kayu Ceramics is only liable for the breach of essential contractual obligations (cardinal obligations).

In such cases, liability is limited to the foreseeable, contract-typical damage.

11. Safety and Course Participation

Participation in the pottery courses is at your own risk.

At the beginning of each course, participants receive instructions on the safe use of materials, tools, and equipment. Participants are obliged to follow the instructor’s directions and to handle all provided materials and tools with care.

Kayu Ceramics assumes no liability for damages caused by improper handling of materials or tools by participants, to the extent legally permissible.

Statutory liability provisions remain unaffected, in particular liability for injury to life, body, or health, as well as cases of intent or gross negligence.

12. Final Provisions

The law of the Federal Republic of Germany shall apply.

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
